Liability & Media Release Waiver

I, the adult participant or parent/guardian of the listed dependents/children, having agreed to participate in New Mettle Farms, LLC programs, film project, or participate in a volunteer endeavor, herein referred to as 'activities', being of legal age, acknowledge, declare, and agree to the following:​​

1. I have voluntarily agreed to participate or the participation of my child(ren) and/or direct dependents in New Mettle Farms, LLC activities as defined above, and do voluntarily execute this release and waiver of liability on behalf of myself, my child(ren), my heirs, and next of kin, my representatives, and my estate.

2. I have been fully informed of the nature and demands of New Mettle Farms, LLC activities. I understand that this activity may include similar activities that could be dangerous to an individual. Such dangers, hazards, and risks of this activity may include but are not limited to injuries caused by the handling of garden or kitchen equipment, wildlife, domesticated animals, physical challenges including but not limited to illness or allergies from contact with people, ingredients, environment, animals, insects, and/or plants within the said environment, injuries sustained while on New Mettle Farms, LLC activity locations, or while participating in any other activities instructors or teachers may choose.

3. I hereby release, waive, discharge and covenant not to sue the participants, teachers, instructors, students, members, owners, contract workers, employees, owners, or lessees of the premises used to conduct the event(s) or program(s), and all for the purpose herein referenced as “Releasees”: from all liability to the undersigned, his/her representatives, assigns, heirs,  and next of kin for any loss or damage, and any claim or demands therefore on account of injury to the persons or property or resulting in the death of the undersigned arising out of or related to the event(s) or program(s), whether caused by negligence or the releasees or otherwise.

4. Hereby agree to indemnify and save and hold harmless the Releasees and each of them from any loss, liability, damage, or cost they may incur arising out of or related to the event(s) or activities whether caused by the negligence of the Releasees or otherwise.

5. Hereby agrees that this Release and Waiver of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of the Releasees and is intended to be as broad and inclusive as is permitted, but the laws of the State in which the event(s) or activities is/are conducted and that if any portion thereof is held invalid, it is agreed that the balance notwithstanding, continues in full legal force and effect.

6. Non-Talent Participant Media Waiver: I hereby grant New Mettle Farms, LLC permission to use, reproduce, publish, or distribute any photographs, videotapes, and/or sound recordings of myself, my child(ren), and/or my direct dependents for use in materials New Mettle Farms, LLC may create. I agree on behalf of myself and my dependents that no compensation is implied or assumed from the use or production of media materials, now or in the future.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, FULLY UNDERSTAND ITS TERMS, AND HAVE SIGNED FREELY AND VOLUNTARILY WITHOUT INDUCEMENT, ASSURANCE, OR GUARANTEE BEING MADE TO ME AND INTEND MY SIGNATURE TO BE A COMPLETE RELEASE OF ALL LIABILITY AS STIPULATED ABOVE AND FOR ALL PERSON’S LISTED AS PART OF MY HOUSEHOLD. THIS WAIVER IS VALID FOR ONE (1) ANNUAL YEAR, JANUARY 1 TO DECEMBER 31 WITHIN THE YEAR OF THE DATE LISTED ON THIS FORM.
